Springside Condominiums offers its residents a bucolic setting in the midst of a small city. Nestled in the heart of the Hudson Valley, these elegantly landscaped lands boast 43 luxury townhomes, and were once even home to the estate of Matthew Vassar, founder of Vassar College.

CHALLENGE:

Springside’s sponsor/developer was not paying the common charges on his unsold, unbuilt units. However, this sponsor alleged any requirement for payment was waived.

RESOLUTION:

Litigation ensued and Associa New York took care of necessary documents to prove the case, as well as assisted and interpreted the legal aspects of the litigation to the board. Ultimately, it was determined that the sponsor was required to pay common charges for all unsold, unbuilt units, and that the obligation cannot be waived.
