Board and Council Responsibilities
The governing documents of a community association spell out
the scope and the role of the board. While it is always critical for
the board and management to understand the scope of board
responsibilities, during a historic pandemic this understanding is
even more critical. Boards have an obligation to act on behalf of
the association, where they have authority to do so. Acting beyond
their authority may create liability for the board and
the community.
On an ongoing basis, the board should review its responsibilities
as outlined in the governing documents, consulting with their
qualified counsel as needed to ensure that they are taking actions
congruent with their authority.
While authority varies by community boards and councils, it
frequently includes:
• Safety of homeowners and residents
• Security of buildings and facilities
• Cleanliness of facilities and amenities
• Homeowner wellness and quality of life
• Prudent fiscal management
• Maximize safe social engagements
• Clear communication
• Asset management
• Final authority in decision making
