9 IS POLITICAL CANVASSING ALLOWED IN HOAS? While your community may have a "No Solicitation" rule, political canvassing may be permitted. Political canvassing is a system where campaign supporters go door to door to connect with people personally. Political parties use canvassing to identify supporters and persuade undecided voters. Not to be confused with solicitation, which is usually tied to making or facilitating a sale of goods or services, political canvassing is intended to sway votes. Because the laws surrounding free speech are broad, prohibiting an HOA resident from knocking on a neighbor's door to talk about a political candidate or distribute political information can be difficult for an HOA to enforce. Also, if a board imposes restrictions on one campaigner and not the other, the legal ramifications for the HOA may be costly. A community's management team may help the HOA enforce its standards, but isn't responsible for the board's decision to allow or restrict canvassing. Further, gated communities and condominiums that offer limited access may restrict any canvassing, including political, by nonresidents.
