6 WHAT ARE THE RULES FOR HANGING AMERICAN FLAGS IN AN HOA? The Freedom to Display the American Flag Act of 2005 is a federal law that permits owners to display a U.S. flag on their property. Although HOA residents are allowed to hang an American flag, the association —not the community management company—may regulate how it's displayed. Many states have enacted laws governing the extent to which HOAs can regulate flag displays. To understand what American flag-flying rules apply to you, refer to your community's governing documents or seek guidance from a board member, community manager, or HOA attorney. HOAs may have the right to limit: • The location of where the flag is displayed • How high off the ground the flag may be displayed • The type and height of flagpoles allowed • The size and condition of the flag • The type and number of lights used to illuminate the flag 7 6 5 4 8 9 10 3 C 11
