What powers do boards have in
a pandemic?
Boards have an obligation to continue to operate the
association despite the current pandemic. However, the
duty of the board in a pandemic is uncharted territory,
and consulting with legal counsel and reviewing governing
documents is critical to ensure roles get fulfilled without
creating unintended liability for the community.
How should boards communicate
with their community?
Boards should have an ongoing dialogue about how to
address emerging issues during the current crisis and consult
counsel as appropriate.
Boards must direct residents to a channel where they can
expect official communications and refrain from engaging in
forums that aren't controlled by the community. Boards should
also review and update online forum rules to ensure they cover
contingencies and remind residents to practice good personal
hygiene and follow directives of health officials.
