There are limits to what your HOA can and can't do.
Every association must adhere to their governing
documents as well as any applicable state and
federal laws. As a member of your association
board, you must work within the confines of these
documents and governing bodies, and failure to do
so will open your board to potential scrutiny and
legal trouble.
Become a scholar of your governing documents.
Having a firm grasp on your existing rules,
regulations, and powers will help inform your
decisions as a board member. Likewise, it'll give you
context to possible future rule changes and will arm
you with the knowledge you need to always proceed
safely and professionally.
Ask for help anytime things are unclear. Being aware
of every local, state, and federal law is simply not
possible for your average board member, so don't be
discouraged if you're not an expert. Your community
association manager (CAM), association attorney,
and other professional community partners can be
a valuable resource when crafting new association
rules. Reach out to them often to validate your new
policies and double-check if there are any legal
roadblocks your board may be unaware of.
